END-USER LICENSE AGREEMENT

Atomrock, LLC

This End-User License Agreement (this "Agreement") is a legal agreement between you ("You") and Atomrock, LLC, a Washington limited liability company ("Atomrock," "we," or "us"), concerning the Atomrock DeviceScope software application and related materials Atomrock makes available to You under this Agreement (collectively, "Atomrock DeviceScope," "DeviceScope," or the "Software," as further defined below). This Agreement covers Atomrock DeviceScope only.

"Software" means Atomrock DeviceScope in all forms Atomrock provides, including the Windows desktop application, devicescope-cli, installer packages (including the MSI), portable/ZIP builds, optional firewall-rule features, bundled or user-downloaded IEEE OUI / vendor-list data, documentation, and any other-platform builds Atomrock makes available under this Agreement. The Software may include optional features that let You select local file paths through the operating system's file picker (for example, browsing to a remote-launcher or helper executable, or a related local path). Selecting a path does not grant Atomrock access to those files. The Software may discover, display, query, and (where You supply credentials and choose to act) change settings on ONVIF-capable devices. The license in Section 2 includes use of the Software by Your authorized personnel on devices You control.

Atomrock DeviceScope is a free Windows desktop utility (and, where Atomrock makes them available, other platforms) that helps You discover and configure Atomrock devices on a local area network using Bonjour/mDNS and ONVIF-related discovery mechanisms. Atomrock DeviceScope is licensed primarily to help You find and configure Atomrock devices. The Software may incidentally discover, identify (including by IEEE OUI / vendor name), query, or configure other mDNS or ONVIF devices on a network You are authorized to use. That incidental capability is not a license to those devices, their firmware, or their vendors, and is not an ONVIF, Apple, IEEE, or third-party endorsement. You use any non-Atomrock device solely at Your risk. Atomrock has no warranty, support, or liability obligation for third-party devices, their credentials, or their configuration. Optional integration with a remote-launcher or other local helper tool that You select on Your computer is a licensed use of DeviceScope under this Agreement; DeviceScope remains free and processes locally. Atomrock DeviceScope is not a remote-access product, and Atomrock does not operate remotes or helper tools for You.

You accept this Agreement only by an affirmative act described in Section 1.2. If You do not agree, do not install, copy, or use Atomrock DeviceScope.


1. Acceptance and Parties

1.1 Parties. This Agreement is between You and Atomrock, LLC.

1.2 Acceptance. You accept this Agreement only by one of the following affirmative acts: (a) selecting "I Agree" (or equivalent) on the MSI / installer license dialog; (b) checking an acceptance box on first run of the graphical application, where that screen is presented; (c) initiating an unattended, silent, or image-based installation, in which case the administrator or organization that initiates that installation accepts this Agreement on behalf of all users of that copy; or (d) for devicescope-cli or a portable/ZIP build, Your first use of that build, provided this Agreement was presented with that build (for example in LICENSE.txt / license.rtf in the distribution root) or at download. The About dialog displays the then-current terms for notice; it is not an independent way to form this Agreement unless it includes an affirmative acceptance control. Mere use after opening About, without one of the acts above, is not sufficient acceptance for a new copy.

1.3 Authority. If You download, install, or use Atomrock DeviceScope on behalf of an organization, You represent that You have authority to bind that organization, and "You" includes that organization.

1.4 Version. This Agreement is Version 1.3, dated 21 September 2026. Atomrock may provide a successor version with an update or a new installer. The successor binds You only if presented for affirmative acceptance (or, for an unattended update You deploy, accepted by the deploying administrator). Continued offering of a free build does not, by itself, amend this Agreement.


2. License Grant

2.1 Grant. Subject to this Agreement, Atomrock grants You a limited, internal, non-exclusive, non-transferable, non-sublicensable, revocable, royalty-free license, free of charge and with no license fee, to install and use Atomrock DeviceScope solely to discover and configure Atomrock devices (and, as described in the preamble, incidentally other mDNS or ONVIF devices) on networks that You are authorized to scan, and to use optional local features such as OS file-picker selection of a remote-launcher or helper path on devices You control, by You and Your authorized personnel on devices You control.

2.2 Platforms. The license covers Atomrock DeviceScope for Windows and other platforms Atomrock makes available under this Agreement.

2.3 No Fee. Atomrock DeviceScope is provided free of charge. No license fee is due to Atomrock for the rights granted in this Section 2.

2.4 No Other Rights. Except for the limited license in this Section 2, no other rights are granted, whether by implication, estoppel, or otherwise.


3. Restrictions

Except to the extent applicable law forbids the following restrictions, You will not, and will not permit others to:

(a) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas of Atomrock DeviceScope;

(b) modify, adapt, translate, or create derivative works of Atomrock DeviceScope;

(c) rent, lease, lend, sell, sublicense, or commercially exploit Atomrock DeviceScope;

(d) remove, obscure, or alter any copyright, trademark, or other proprietary notices;

(e) use Atomrock DeviceScope to attack, disrupt, or unauthorizedly access any network, system, or device, or for any unlawful purpose;

(f) use Atomrock DeviceScope to attack, scan, or configure systems on networks You are not authorized to use, or use Atomrock DeviceScope as a general hacking, penetration-testing, or security-testing tool; incidental discovery or identification of non-Atomrock mDNS or ONVIF devices on an authorized network is not, by itself, a breach of this Section 3(f); or

(g) redistribute, publish, or otherwise make Atomrock DeviceScope available to third parties, except as expressly permitted in Section 4 (Redistribution and Enabler Carve-Out).


4. Redistribution and Enabler Carve-Out

4.1 General Prohibition. Redistribution of Atomrock DeviceScope (including the installer) is prohibited without Atomrock's prior written authorization.

4.2 Atomrock Enabler Carve-Out. Notwithstanding Section 4.1, a party that has a then-current written agreement with Atomrock designating it as an Atomrock Enabler or equivalent channel-partner status (an "Enabler," and that agreement, the "Enabler agreement") may distribute the Atomrock DeviceScope installer unchanged during the valid term of that Enabler agreement, provided that:

(a) You will distribute the installer and Software unchanged (You will not modify them, repackage them in a way that alters the Software, or remove notices);

(b) You will keep all copyright and proprietary notices intact;

(c) You will not charge a fee for Atomrock DeviceScope itself; and

(d) You will distribute only while the applicable Atomrock Enabler agreement remains in effect.

4.3 End of Enabler Rights. When the Enabler agreement ends or is terminated, the redistribution right in Section 4.2 ends immediately. Continued redistribution after that time requires a new written authorization from Atomrock.

4.4 No Broader Appointment. Section 4.2 does not appoint You as a reseller, distributor, or agent for Atomrock hardware, firmware, AtomCloud, or any other Atomrock product or service.

4.5 Flow-down. An Enabler may redistribute only if each recipient is given this Agreement (or an installer that presents it unchanged) and accepts it before use. The Enabler will not wrap, re-brand, or silently install Atomrock DeviceScope in a way that hides this Agreement.

4.6 No Agency. An Enabler is not Atomrock's agent, partner, or authorized support provider for Atomrock DeviceScope by reason of Section 4. End users have no contract with Atomrock except this Agreement.

4.7 Precedence. If this Section 4 conflicts with a then-current written Enabler agreement, that Enabler agreement controls only as between Atomrock and that Enabler on the right to redistribute. This Agreement always controls the end user's license to the Software.


5. Ownership and Intellectual Property

5.1 Ownership. The Software is licensed, not sold. Atomrock and its licensors retain all right, title, and interest, including intellectual property rights, in the Software. No license is granted, by implication or otherwise, to Atomrock hardware, firmware, trademarks, or AtomCloud, except the right to use the Software as expressly set out in Section 2. Separate terms govern Atomrock hardware, firmware, AtomCloud, cloud services, APIs, and other Atomrock products and services.

5.2 Feedback. If You provide suggestions or feedback about Atomrock DeviceScope, You grant Atomrock a perpetual, irrevocable, worldwide, royalty-free license to use and exploit that feedback without restriction or obligation to You.


5A. Third-Party Components, IEEE Data, and Marks

5A.1 Third-Party Components. The Software includes or uses third-party software and data under separate licenses (including open-source licenses). Those licenses are provided in notices Atomrock makes available with the Software (About and/or a NOTICES / LICENSE file). If a third-party license conflicts with this Agreement for that component, the third-party license controls for that component only.

5A.2 IEEE OUI / Vendor List. Bundled or downloaded registrant data originates from IEEE public listings. Atomrock does not claim ownership of IEEE data, does not warrant completeness or accuracy, and does not receive Your scan results when You download a refresh. Your use of IEEE data remains subject to IEEE's then-current terms. The optional download is user-initiated only and is not telemetry.

5A.3 Marks. Atomrock, Atomrock DeviceScope, DeviceScope, and AtomCloud are Atomrock marks. Apple, Bonjour, ONVIF, IEEE, Microsoft, Windows, and other marks are the property of their owners. No right is granted to use any mark except as needed to run the Software. Nothing in this Agreement represents that the Software is ONVIF conformant or ONVIF certified. The Software is not an Apple or IEEE product.


6. No Data Collection; Privacy

6.1 No Telemetry. Atomrock DeviceScope does not collect user information or scanned-device data for Atomrock. Atomrock DeviceScope does not include telemetry or "phone-home" reporting to Atomrock. Atomrock does not receive file-picker selections, remote-launcher browse paths, or other local path selections You make in the Software as telemetry.

6.2 Optional OUI Vendor List. Atomrock DeviceScope may offer an optional, user-initiated download of a public Organizationally Unique Identifier (OUI) vendor list (or similar public vendor reference). That download occurs only if You choose to initiate it. It is not collection of Your personal information, and it is not collection of scanned-device data beyond the public vendor list You choose to fetch. Atomrock does not receive Your scan results through that optional download. Section 5A.2 also applies to IEEE OUI / vendor-list data.

6.3 Local Processing. Discovery and configuration activity occurs on Your local environment and networks under Your control and responsibility. Local paths and files You select through the operating system's file picker (including remote-launcher or helper executable paths) stay on Your computer unless You separately transmit them.


7. Network Scanning Disclaimer

7.1 Your Authorization Required. You may use Atomrock DeviceScope only to scan networks that You own, control, or have express permission to scan. You are solely responsible for obtaining any required authorizations before scanning.

7.2 No Liability for Scan Outcomes. Atomrock will not be liable for scan results, false positives or false negatives, incomplete discovery, disruption of networks or devices, misconfiguration, or any third-party claims arising from Your scanning or configuration activities. Without limiting the foregoing, Atomrock will have no warranty, support, or liability obligation for third-party (non-Atomrock) devices that the Software may incidentally discover, identify, query, or configure on an authorized network.

7.3 Misuse. Atomrock is not responsible for misuse of Atomrock DeviceScope, including unauthorized scanning or use contrary to this Agreement or applicable law.


8. Local Environment Disclaimer

8.1 Your Environment. Atomrock DeviceScope runs on Your computer and network. Atomrock will not be responsible for issues arising from Your operating system, firewall settings, Windows network profile (including Public network profile), antivirus or endpoint security software, drivers, permissions, user account control, or similar local configuration. Optional firewall-rule features change Your computer's firewall configuration only when You choose to run them, and those changes are at Your sole risk.

8.2 Dependencies. Atomrock DeviceScope may depend on third-party or platform components such as Bonjour-related services and ONVIF-related mechanisms. Atomrock does not warrant the availability, compatibility, or behavior of those dependencies on Your system.

8.3 Local PC Issues. Atomrock is not responsible for local PC issues, performance impact, or conflicts with other software on Your machine.


8A. Device Credentials, Configuration, and Exports

8A.1 Credentials and Local Storage. Credentials You enter are processed locally on Your computer and are not sent to Atomrock. You are solely responsible for credential strength, storage, and for any authentication method You enable (including ONVIF PasswordText or other plaintext or weakly protected methods). Local credential storage is at Your sole risk.

8A.2 Configuration Changes. Any configuration change, user/password rotation, network change, encoder change, or clock change is made by You to a device You are authorized to administer, at Your sole risk, and may make a device unreachable or insecure. Atomrock has no liability for device lockout, misconfiguration, downtime, or security exposure resulting from Your use of the Software's configuration or write features.

8A.3 Not a Security Control. Atomrock DeviceScope is not a security control, penetration-testing tool, or substitute for physical or system security.

8A.4 Exports and Reports. Export files and reports are created under Your control and may contain network identifiers (including IP addresses, MAC addresses, hostnames, and user lists). You are responsible for that data. Atomrock does not receive those files unless You separately send them (for example in a support email).

8A.5 Local Paths and Helper Tools. You are solely responsible for choosing trusted local paths and executables when using optional OS file-picker or remote-launcher / helper features. Launching, pointing to, or otherwise invoking third-party tools from paths You select is at Your sole risk. Atomrock does not receive those path selections as telemetry and does not operate remotes or helper tools for You.


9. Beta / Unsigned Software Notice

9.1 Beta Status. You acknowledge that Atomrock DeviceScope may be provided as unsigned beta software. Features may be incomplete, may change without notice, or may contain defects.

9.2 AS IS Beta. BETA BUILDS ARE PROVIDED STRICTLY AS IS. You acknowledge the risks of running unsigned or pre-release software, including potential compatibility, security, and stability issues on Your system.


10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATOMROCK DEVICESCOPE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. ATOMROCK DOES NOT WARRANT THAT ATOMROCK DEVICESCOPE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT DISCOVERY OR CONFIGURATION RESULTS WILL BE ACCURATE OR COMPLETE.


11. Limitation of Liability

11.1 Liability Cap. BECAUSE ATOMROCK DEVICESCOPE IS PROVIDED FREE OF CHARGE, ATOMROCK'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR ATOMROCK DEVICESCOPE WILL NOT EXCEED US $0 (ZERO U.S. DOLLARS).

11.2 Exclusion of Consequential Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMROCK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.3 Savings; Non-Waivable Rights. The US $0 cap and the exclusion of consequential damages do not apply to liability that applicable law does not allow to be limited or excluded, including (where such a limitation is forbidden) Atomrock's fraud, willful misconduct, or gross negligence, or liability for death or personal injury. Nothing in this Agreement limits rights that cannot be waived under mandatory consumer protection or other laws that apply to You. If such laws apply and cannot be disclaimed, Atomrock's liability is limited to the minimum extent permitted by those laws. For clarity, where a monetary remedy is mandatory and this Agreement's US $0 cap cannot apply, liability is limited to the minimum amount required by that law.

11.4 Exclusive Remedy. Your sole remedy for any claim relating to the Software is to stop using it and uninstall it. If a court requires a monetary remedy despite this Section 11, that remedy will be the minimum amount that court is required to award (and is not an agreement to charge a fee).

11.5 Specific Exclusions. Without limiting this Section 11, Atomrock is not liable for lost data, lost credentials, device downtime, failed or unwanted device configuration, security exposure, or third-party claims arising from Your scanning or configuration.


12. Indemnity

You will defend and indemnify Atomrock and its members, officers, and employees against third-party claims arising from: (a) Your scanning or use of a network or device You were not authorized to use; (b) Your configuration or credential practices; (c) Your violation of this Agreement or law; or (d) Your redistribution other than as permitted in Section 4. This Section 12 does not require You to indemnify Atomrock for a claim that the Software, as provided by Atomrock and used in accordance with this Agreement, infringes a third party's intellectual property rights, or for Atomrock's willful misconduct. If You are a consumer and applicable law forbids this indemnity, this Section 12 does not apply to You.


13. Export and Sanctions

The Software is subject to U.S. export-control and sanctions laws (including the U.S. Export Administration Regulations (EAR) and OFAC rules) and other applicable export laws. You represent that You are not a denied or restricted party and are not located in, and will not use or export the Software to, a comprehensively sanctioned jurisdiction or a prohibited end use. You will not export, re-export, or transfer the Software except as those laws allow.


14. Termination; No Support; Withdrawal

14.1 Termination. This Agreement terminates automatically if You breach it. Atomrock may also terminate this Agreement at any time for the free Software. You may terminate by uninstalling and ceasing all use of Atomrock DeviceScope.

14.2 No Support; Withdrawal. Atomrock has no obligation to provide support, maintenance, updates, or any particular build. Atomrock may modify, sign or leave unsigned, or withdraw the Software at any time. If Atomrock terminates this Agreement, You will stop use and uninstall.

14.3 Effect. Upon termination, You must stop using Atomrock DeviceScope and uninstall all copies in Your possession or control. Sections 3, 5, 5A, 6, 7, 8, 8A, 9, 10, 11, 12, 13, 15, 16, and 17 survive termination, as do any other provisions that by their nature should survive.


15. Governing Law; Venue; Language

15.1 Governing Law. This Agreement is governed by the laws of the State of Washington, United States of America, without regard to conflict-of-laws principles.

15.2 Venue. You consent to personal jurisdiction and exclusive venue in the state or federal courts located in King County, Washington, and waive any inconvenient-forum objection, except where a non-waivable consumer-protection law requires a different forum or law for You. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.3 English Controlling. The English language version of this Agreement controls. Any Traditional Chinese (ZH-TW), Japanese, or other translation is for convenience only and does not modify the English text.


16. General

16.1 Entire Agreement. This Agreement is the entire agreement between You and Atomrock concerning Atomrock DeviceScope and supersedes prior or contemporaneous understandings on that subject. It does not amend any separate Atomrock hardware, firmware, AtomCloud, Enabler, or other commercial agreement except as expressly stated for Atomrock DeviceScope redistribution in Section 4.

16.2 Severability. If any provision is held unenforceable, the remainder remains in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

16.3 No Waiver. Failure to enforce a provision is not a waiver of that provision or any other provision.

16.4 Assignment. You may not assign or transfer this Agreement without Atomrock's prior written consent. Atomrock may assign this Agreement without Your consent. Any attempted assignment in violation of this section is void.

16.5 Notices. Notices to Atomrock under this Agreement may be sent by email to support@atomrock.com, Attn: Legal. Email to that address with Attn: Legal is sufficient notice under this Agreement. Notices may also be sent by mail to the operational address in Section 17.

16.6 U.S. Government. The Software is "commercial computer software." If acquired by or on behalf of the U.S. Government, use is subject to this Agreement as provided in FAR 12.212 and DFARS 227.7202 (or successor).
